Recreational marijuana use became legal in New York on March 31st, 2021 through the enactment of the Marijuana Regulation and Tax Act. This act specifically distinguishes recreational cannabis, also referred to as "adult use" cannabis, from medical marijuana within the state's legal framework.
In 2014, the state of New York legalized medical marijuana under the Compassionate Care Act. Despite the differences in legislation, all cannabis-related programs, including recreational marijuana use, are subject to regulation by The Office of Cannabis Management (OCM). The OCM is overseen by a five-member Cannabis Control Board.
It wasn't until November 2022 that the first licenses for recreational dispensaries were issued by the state. During the 20-month period between legalization and the issuance of licenses, New York experienced an increase in unlicensed dispensaries that catered to recreational use.
