Getting to know regulations in New Mexico
On April 12, 2021, Governor Michelle Lujan Grisham officially approved the Cannabis Regulation Act, which effectively legalized the use of recreational cannabis for adults aged 21 and above. This comprehensive act encompasses various aspects such as cultivation, manufacturing, purchasing, possession, and consumption of recreational cannabis.
Notably, it also merged the regulations for both adult-use and medical cannabis under a single commercial cannabis framework, overseen by the Cannabis Control Division. It is important to note that the Department of Health will continue to supervise the medical cannabis patient program.
As of April 1, 2022, the first authorized sales of recreational cannabis have commenced in New Mexico. Despite the legalization, there are still regulations in place that govern the entire process of cannabis production, from seed to consumption.
Licensing
The issuance of 10 distinct license types to business owners throughout New Mexico is carried out by the Cannabis Control Division. This division collaborates with various entities such as the Department of Public Safety, Office of the State Engineer, Environment Department, as well as other state agencies, tribes, and Pueblos. Their collective efforts aim to support applicants in obtaining the necessary licenses.
